Employment tribunal fee refund scheme launched
The Government launched the first stage of the employment tribunal fee refund scheme in October; to refund employment tribunal fees to those who have made claims, after the Supreme Court ruled in July that the 2013 introduction of fees of up to £1,600 to bring an employment claim breached domestic and EU law.
The opening four-week stage of the phased implementation scheme saw around 1,000 people offered the chance to complete applications. This first phase has now been successfully completed, all individuals not involved in the initial pilot process, who think they may be eligible for a refund can now apply.
The refund scheme rolls out after Government ministers promised their commitment to reimbursing those who paid employment tribunal fees following a Supreme Court judgment in July.
The court recognised the importance of the role that fees can play, but ruled overall that the government had not met the appropriate balance.
Individuals will be refunded their original fee, with successful applicants to the refund scheme being paid an interest of 0.5%, calculated from the date of the original payment to the the refund date.
The government has been working with trade unions, to create the scheme, they have supported large multiple claims which involve hundreds of claimants, and ahead of the full launch, individuals were approached to pre-register their interest in applying.
How to apply for the employment tribunal fee refund scheme
Individuals can get a refund if they paid fees at an Employment Tribunal or Employment Appeals Tribunal between 29 July 2013 and 26 July 2017.
You can apply online if:
- you haven’t changed your name since you made the claim to the tribunal
- your claim was against one employer
- you have a UK bank account
